
A Union should compensate producers affiliated with the Rural Union of Farmlands of Julius (MT) for the values of the Rural Worker Assistance Fund (Funrural) paid on the gross revenue of the soybean sold to traders between 2013 and 2018. The decision was made by the 7th Panel of the Federal Court of the 1st Region (TRF1).
The action was filed by the Rural Union of Campos de Júlio in 2018. According to the ruling, rural producers do not need to bear the Funrural contribution levied on revenue from indirect exports, in addition to obliging the Union to return amounts paid unduly since May 15, 2013.
According to the Federal Court's decision, the Ruling produces effects capable of reviewing possible installments involving Funrural export debts and charges by the Federal Revenue Service.
Funrural is a social security tax that is levied on the gross sales value of all rural production.
President of the Rural Union of Campos de Júlio, Glauber Silveira, comments that currently around 200 thousand hectares of soybeans are planted in the municipality. Production is estimated at 600 thousand tons per year.
According to lawyers Flávia Carrazzone and Juliana Guilherme, responsible for the Rural Union's action, a survey will be carried out among rural producers to identify the amounts collected unduly so that they can be reimbursed.
Expectation is that the Union will not appeal
A expectation is that the Union does not appeal of the Court's decision, since this is a topic on which the Federal Supreme Court (STF) has already taken a position in the same sense in the decision on General Repercussion.
